When a Tenant Is ‘Blacklisted’

Several years ago I joined a
lawsuit with my neighbors against my landlord, who had told the
tenants of our rental building for several years that it was
nonstabilized. The case settled, and we were paid back overpayments
and damages. Recently I applied for an apartment in another
building, and the management company discovered that I had been
involved in the lawsuit. I was denied the new apartment. Am I on
some blacklist because of the previous litigation, and can I get my
name removed from it?
A “The tenant may have been blacklisted, but he can
protect himself,” said Leon I. Behar, a Manhattan real estate
litigation lawyer. If a landlord withholds an apartment based on a
tenant screening report, he is required to notify the tenant, in
writing, of the reason for the denial and the company used for the
screening. He noted that Housing Court cases can appear on the court
records for seven years after the case was filed. Detailed
information on such records can be obtained on the Web site of the
City-Wide Task Force on Housing Court at
www.cwtfhc.org/for-tenants/tenant-blacklist. And since February
2010, New York City landlords of buildings with five or more
apartments must notify prospective tenants if they use tenant
screening reports, and provide the name and address of the screening
bureau. Tenants can then request a free copy of any report, and can
use that to try to clear up any erroneous information.

PLANTING NEW TREES ON COLUMBUS AVE!
TREES TO BE PLANTED ALONG COLUMBUS AVENUE FROM 97th – 100th STREETS
Sixteen trees in several varieties will be planted during November on the east side of Columbus Avenue between 97th and 100th Streets.
These will replace the trees removed in 2008 to allow for construction of three residential and several commercial buildings along this superblock.
Arrangements for the planting were completed through the efforts of Columbus Square Management, the New York City Parks Department, and the Park West Village Tree/Landscape Committee. Harder Tree and Landscape Services of Long Island was contracted to do the planting and maintain the trees over the next two years.

Park West Village resident Russell Banks said it’s hard for him to stomach the idea of a rent increase when he’s been waiting for months to get a replacement for his air conditioner, which stopped working last summer. “More money, less service —that seems to be the problem,” Banks said, noting that he also had to wait seven months for his stove to be repaired last year.
In March, the city’s Division of Housing and Community Renewal sent residents of Park West Village buildings 784, 788 and 792—three of the complex’s seven apartment buildings along Columbus Avenue from 97th to 100th streets—a letter stating that the landlord had applied for a rent increase.
Landlords can apply for such increases after making repairs or providing new appliances, like stoves or refrigerators.
“We’re contesting the increase,” said Albina De Meio, vice president of the Park West Village Tenants’ Association. “We responded to it through legal counsel, but we haven’t heard anything yet.”

The Department of Transportation released 2010 data on traffic fatalities Feb. 7, 2011, announcing that the city has sustained a four-year low in vehicle-related deaths. But Upper West Side community activists say there is more work to be done to make streets safer for pedestrians.
Several advocacy groups submitted a proposal to the Department of Transportation last year to address problems of pedestrian safety along the 96th Street corridor, which encompasses streets between Riverside Park and Central Park on West 95th, 96th and 97th streets. There are many schools in this area, and local school officials and parents have been vocal advocates of increased safety measures from the DOT....[continued]

City Law Allowing Tenants to Sue Over Harassment Upheld

The Appellate Division, First Department, yesterday sustained the constitutionality of a New York City law enacted in 2008 that gave tenants the right to sue in Housing Court their landlords for harassment.
The ruling in Prometheus Realty Corp. v. City of New York, 111132/08, rebuffed a challenge to the 2008 law mounted by the Rent Stabilization Association (RSA), a group that represents the interests of approximately 25,000 owners and managers of apartment buildings in New York City.
The RSA and two real-estate companies attacked the city law, the New York City Tenant Protection Act, as impermissibly expanding the jurisdiction of the Housing Court beyond the limits set by the state Constitution.

ARE YOU BEING OVERCHARGED?
If you have moved into an apartment in 784, 788 or 792 Columbus Avenue, there is a strong possibility that you are being overcharged.
These buildings are covered by the New York State Rent Stabilization Law which requires landlords to follow a specific formula when setting new rents following an apartment vacancy. The owners of Park West Village have a history of overcharging new tenants by inflating the costs of apartment renovations
What should you do? Call the New York State Division of Housing and Community Renewal (DHCR) at 718-739-6400 and request the rent history on your apartment.
Upon receiving the rent history, call the PWVTA Hotline at 212-662-2610 to set up an appointment with a member of the Overcharge Committee who will help you through the process.
